Features purpose and production seizure of documents when investigating crimes related to the public procurements in Ukraine

Introduction: The article highlights the particular destination and production sei­zure of documents in the investigation of crimes related to the conduct of public pro­curement in Ukraine. Purpose: the analysis of legal support of excavation and analysis of the documents relevant to the investigation, study the characteristics and purpose of production seizure of documents in the investigation of crimes related to the conduct of public procurement in Ukraine. Methods: general scientific article used (dialectic, anal­ysis and synthesis, abstraction and specification) and private scientific research methods (formal-legal, comparative legal, technical and legal). Results: the analysis of regulato­ry legal provision of the recess in Ukraine showed that one of the main problems that arise when the recess appointment and conduct of cases related to the conduct of public procurement in Ukraine is the lack of regulation of the issue of the present members of the investigative activities of operational units. Also during the investigation, there may be problems associated with the existence of the provisions under Art. 161 of the Crim­inal Procedural Code of Ukraine, namely in relation to things that are denied access. Highlighted categories of documents that are relevant to the investigation of crimes in the area of public procurement and the person in whose possession these documents are located. Conclusions: normative-legal regulation of holding recesses in Ukraine re­quires further development and study. To date, the above procedural action significantly tightened the need to obtain a permit in court, which carries no legal force to the owner of seized items, which adversely affects the investigation of crimes in the area of public procurement.
