The paper presents the situation of committing credit fraud as one of the key elements of its criminalistic characteristics. The essence and the content of this concept are analyzed, the key elements of the situation are determined in the context of the analyzed fraud. At the same time the author makes a distinction between the factors that constitute the theft of bank funds, which is realized through consumer and corporate lending.
