The peculiarities of legal regulation of the pledge termination, in the case of acquisition of the mortgaged property by a bona fide person

The article deals with certain provisions of civil legislation (Civil Code of the Russian Federation), in particular articles 174.1, 302 and 353 regulating the termination of pledge in connection with the acquisition of mortgaged property by a person who did not and should not have known that it is a security. The author reveals the peculiarities of the system interaction of these norms both with each other and with separate provisions regulating relations in the sphere of sale and purchase, and the specifics of their practical application, including the distribution of the burden of proof of legally significant circumstances.
