Features investigative actions and measures of criminal proceedings against lawyers in the legislation of Ukraine

Purpose: Scientific and practical study of the peculiarities of the investigation and measures to ensure the criminal proceedings against a lawyer under the laws of Ukraine, development and submission of proposals for the improvement of the criminal - procedural legislation of Ukraine and the Law of Ukraine «On the Bar and Advocacy». Methodology: Use formal legal method, comparative law and the method of analysis. Results: In the scientific article features of investigative actions and measures to ensure the criminal proceedings against a lawyer in accordance with the Law of Ukraine «On Advocacy and Legal Practice» from 05.07.2012 and the Criminal Code of Ukraine protsesualnom from 13.04.2012. The author in his scientific article concludes that the existing procedural order of the investigative actions and measures to ensure the criminal proceedings against the lawyer does not ensure its complete protection against arbitrariness on the part of law enforcement agencies. In the scientific article states that guarantees the independence of lawyers, embodied in the Law of Ukraine «On the Legal Profession and Legal Practice» is not fully reflected in the Code of Criminal Procedure, in connection with which the author comes to the conclusion that the investigative actions and measures to ensure that criminal proceedings against a lawyer should be more clearly regulated in the Code of Criminal Procedure by making changes and additions to the criminal procedure legislation of Ukraine. Novelty/originality/value: Article has high academic value and practical significance, since it contains the author of the novel generalizations, conclusions and suggestions for improvement of the criminal procedure legislation of Ukraine and the Law of Ukraine «On the Bar and Advocacy».
