Specifics of resolving disputes related to obtaining the notarized consent of the spouse to perform transactions on the alienation of common property

The article deals with the content aspects of the spouse's consent to the alienation of real estate. Attention is paid to the problem of applying the consequences of invalidity of recognition of a transaction made without notarial consent, as well as a transaction whose consent was given under the influence of error in accordance with civil and family law. Based on the study of judicial practice, conclusions are drawn about ambiguity in the application of the rules governing the legal consequences of the invalidity of the disputed transaction related to the obligation to obtain notarized consent of the spouse.
