The present study provides information on the course of the traditional judicial process in Kyrgyzstan after annexation to the Russian Empire, the types of crimes and the punishment procedure. There is considered the concept of crime in the context of the Kirghiz society of that time. The history of the judicial system of Kyrgyzstan is also analyzed. The nomadic Kirghiz had a biys' court, which performed judicial functions. However, the social term “biy” associated with administrative positions had been known for a long time, and starting from the middle of the 19th century it began to be used in the judicial field. Thus, starting from that period the primary judicial instance was the biys' court, which competences were unlimited. The history of the formation and development of the judicial system of the Kyrgyz Republic is an integral part of the national history, has great educational and practical significance and, of course, takes an important place in the development of the state as a whole. Undoubtedly, one of the most topical issues these days is the increasing public confidence in the judicial system, restoring its traditional principles of justice and impartiality in the traditional judicial system of the Kirghiz people, learning lessons from our past.
