Features of legislative build-up of the objective side of the crime set out in the article 123 of the Criminal Code of the Russian Federation

Purpose: To study the theoretical and practical problems of determining the objective side of the illegal conduct of artificial termination of pregnancy. Methodology: Legalistic and comparative methods were used. Results: The article suggests that the establishment of a causal relationship can be present only if the termination of a pregnancy preceded the criminal result and was a necessary condition for its occurrence. Severe damage to health or death may be caused not by induced abortion, but by other factors, which may include the following: the specific features of the woman’s organism, any diseases or pathologies she has, the behavior of the woman or third parties, etc. Novelty/originality/value: The novelty of the article lies in the fact that the author forms a current understanding of the nature of the objective side of the crime of illegal conduct of an induced abortion.
