Several aspects of the servitude doctrine in contemporaneous Russian law

The article discusses some issues of Russia's current servitude law: differentiation of limits and encumbrances of property rights to real estate; the ratio of corporeal and obligatory rights in the establishment of an easement; subject composition of the easement; protection servitude. As a result of the study, the author determines the criterion for delineating the limits and encumbrances of property rights, the optimal subject composition of the servitude, indicates a close relationship between real and liability rights in servitude law, argues in favor of immediate protection of the easement by negatory suits.
