Delimitation of extremism from lawful behavior in the context of art. 20.3, 20.3.1 of the Administrative Code and art. 280, 282 of the Criminal Code

Introduction: the article examines the observance of human and civil rights and freedoms guaranteed by the Constitution of the Russian Federation: a distinction is made between lawful behavior and extremist manifestations. The prevalence of cases of unlawful bringing of persons to justice for the commission of extremist offenses is noted. Materials and methods: the regulatory framework of the study is formed by the Constitution of the Russian Federation, generally accepted principles and norms of international law, normative legal acts governing the application of legislation in the fight against extremism. The methodological basis of the study was the general dialectical method of scientific knowledge, which is universal in nature, the methods of logical deduction, induction, cognitive methods, comparison, analysis, synthesis and description. Results allowed to form criteria that facilitate the distinction between legitimate behavior and extremist manifestations. Reasonings are supported by actual examples from practical activities, recommendations that can be used in the process of studying administrative, criminal law, in law enforcement. Summary and conclusions: analyzing the legal acts regulating the application of criminal law in the fight against extremism, there is a lack of common understanding of the terms of dispositions of Art. 20.3., 20.3.1. of the Administrative Code and Art. 280, 282 of the Criminal Code.
