Liability of a legal entity in the light of the new Code of the Russian Federation on Administrative Offenses

The responsibility of legal entities existing in the administrative-tort legislation for almost two decades, it would seem, has already been said enough and fully. However, the relevance of the topic has not exhausted its borders, especially in anticipation of the adoption of a new codified law on administrative offenses. Discussion of the new Code of the Russian Federation on administrative offenses by administrative scientists is quite active, as a result, more and more flaws in the new law are revealed. The imperfection of the draft new Code of the Russian Federation on administrative offenses is obvious, this fact is reflected in many scientific papers on various issues relating to both the substantive and procedural parts of the law. Materials and methods: the administrative-tort legislation is the normative basis of the study, based on the analysis of the current Code of the Russian Federation on administrative offenses, the authors compare with the draft of a new codified document. The study is based on the works of authoritative scientists in the field of administrative law. The methodological basis is a comparative analysis of individual acts of government, generalization methods, descriptions. Results of the study: an analysis of the work of authors who studied the issues of administrative responsibility of a legal entity is carried out, the necessity of revising the admissibility of bringing a collective subject to administrative responsibility is substantiated. Findings and conclusions: in conclusion, the authors conclude that the concept of the new Code of the Russian Federation on administrative offenses is not formulated enough regarding the liability of a legal entity.
