The article provides a legal analysis of Art. 345-1, which was first introduced into the Criminal Code of the Republic of Kazakhstan in December 2019 to strengthen responsibility for the commission of a crime by persons driving vehicles while intoxicated. The article emphasizes the increased social danger and criminological conditionality of the act, reveals its objective and subjective characteristics and features of qualification, the procedure for medical examination of a person, provides examples from judicial practice and indicates its differences from criminal offences under articles 345 and 358 of the Criminal Code of the Republic of Kazakhstan.
