Approaches to the formation of the limitations of copyright and neighboring rights Russian and foreign legislation in the digital era

The paper presents an analysis of trends in limitations of copyright and related rights in the digital era in Russian and foreign law. The main approaches to setting limits of copyright and related rights in the cases of free use of the results of creativity without the consent of the owners in the area of freedom of expression, for distance learning and research activities, in digital libraries, as well as the limitation of liability of providers and exemptions from the legal protection of technological protection exclusive rights. Identified major gaps and contradictions in the Russian legislation and proposed the basic directions of improving the national system of restrictions on exclusive rights subject to progressive experience in foreign countries.
