Obtaining computer information: problems of theory and practice

Introduction: the article examines the changes made to the Federal law «On operational search activity» dated August 12, 1995 № 144-FZ, in particular the introduction of a new operational search activity «Obtaining computer information». The authors examine in detail the concept and types of operational-search activities, reveals the essence, determines the conditions and methods of obtaining computer information, a comparative analysis of the considered operational-search activities with others provided for in art. 6 of the Federal law «On operational search activity», the similarities and differences are identified, the most problematic issues that arose in the operational-search theory and practice after the introduction of this operational-search event as an independent one are determined. Materials and Methods: the normative basis of the study is formed by the Constitution of the Russian Federation, other Federal laws that are directly related to the legal basis for the implementation of operational-search activities, as well as by-laws regulatory legal acts of Federal bodies of state power, regulatory legal acts of bodies engaged in operational-search activities, regulating the organization and tactics of operational-search activities...
