The concept of function of law in modern legal theory

The paper deals with defining and using the concept of function of law in modern legal theory. The crux of the matter is the number of significant shortcomings in understanding and using the law as a legal means to address social problems, the excessive legislative redundancy and the lack of adequate analysis and understanding of the function of law as one of the main types of legal instruments. In legal theory, the concept of function of law is not developed. To a large extent, the purpose of the law and the determination of its properties are explained by the category of standard and its derived static characteristics. The regulatory characteristic of the law should be supplemented by the identification of its functional properties reflecting the systematic and controlled process of making the legal opportunity into reality.
