Concept and characteristics of recorded crime

Introduction. The article presents and substantiates the features that reveal the content of the definition of “professional crime” as a separate type of crime that requires a comprehensive criminological study. Materials and Мethods. The materials of the study were the results of scientific research in criminology, the norms of the current legislation of the Russian Federation and individual neighboring countries, departmental regulatory legal acts of the Ministry of Internal Affairs of Russia governing the procedure for implementing crime prevention, statistical data of the Federal State Institution "GIAC of the Ministry of Internal Affairs of Russia". The study used the dialectical method, analyzed scientific, regulatory and legal sources, used methods of generalization and grouping of data, as well as the method of comparative law. The Results of the Study allowed to substantiate the presence of characteristic features for professional crime. To consider this type of crime through the system of preventive registration of persons who have committed certain categories of crimes, and also to identify the criteria according to which the said persons represent an increased public danger, requiring additional control from law enforcement agencies and are considered special subjects to whom special preventive measures are applicable. Findings and Conclusions. The conducted analysis of legislation and scientific literature made it possible to reveal the characteristics of preventive crime as an independent type of crime, through which the content of the definition of “pro-registered crime” was presented, and criteria were identified that make it possible to consider persons on preventive registration as special subjects to whom special preventive measures are applicable.
