The concept and content of state coercive measures in the form of placement of minors in a temporary detention center for juvenile offenders

The questions of forced isolation of juvenile offenders in the conditions of construction of humanistic justice are relevant and debatable. Taking into account the public concern about the state of juvenile criminality and its current trends, institutions and services of the system for the prevention of neglect and juvenile offences are criticized, due to the insufficient effectiveness of their activities. These trends are not unreasonably extended to such institutions of forced isolation, such as Temporary Detention Centers for Juvenile Offenders of Internal Affairs Bodies (TDСOF IAB). Despite the departmental affiliation of temporary detention centers for juvenile offenders of the Internal Affairs agencies to the Ministry of Internal Affairs of the Russian Federation, the status of these institutions remains uncertain and debatable, and the current state of theoretical understanding of the specifics of the placement of minors in TDСOF IAB should be recognized as insufficient and requires development. The article deals with the placement of minors in the Department of Internal Affairs in terms of its functional role. The author comes to the conclusion that the room in the TDСOF IAB of the Department of Internal Affairs has a certain specificity and combines executive and security, isolation and educational and preventive elements. The author analyzes the existing definitions of the concept of measures in the form of placement in the TDСOF IAB of the Department of Internal Affairs, and also formulates the author’s position on the concept of measures of influence in the form of placement of minors in the TDСOF IAB of the Department of Internal Affairs.
