The article deals with a new legal phenomenon - the evasion of a law with an illegal intent, which is interpreted by a legislator as a form of abuse of a right. The author reviews some opinions of the scientists regarding this issue in their historical retrospection. The forensic practices, which predetermined the mentioned form of a right abuse, are summarized.
