The article is devoted to the urgent problem of legal regulation of the unauthorized construction. The author shows that the issues of construction law worried about both legislators pre-revolutionary and Soviet periods. The further optimization of the search mechanism for regulation of unauthorized construction will contribute the development of construction and land law.
