In connection with the introduction of new regulations in civil law concerning failure to perform the contract, and by exercising the rights to it, the author examines the concept of «unilateral refusal to perform the contract», analyzes the features of the right to it, in particular, the way-out of the contract, the base, which admit failure, the time of termination or modification of the contract.
