Purpose: Consideration of topical issues of a regulation of an order of judicial proceedings in court of the first instance Methodology: The author applied a historical and legal method, a formal - legal method, a method of the included supervision. Results: In article the order of consideration and permission of affairs in court of the first instance, the general conditions, separate stages of judicial proceedings is investigated, their purposes and value are defined, the role of court in this stage is designated. Novelty/originality/value: Work is of the high scientific value as is one of the first attempts of the modern analysis of an order of judicial proceedings of affairs in courts of the Republic of Tajikistan.
