Consequences and risks of unilateral refusal builder of the agreement share in construction

The author of this article identifies the legal problems faced by a participant of a shared construction in the event of the developer’s unilateral refusal from performance of the shared construction agreement; the necessity to improve legislation in this part has been considered. The article deals with the procedure for termination of the shared construction agreement, the effects of such termination for a participant of a shared construction, as well as the risks connected with the developer’s bad faith activities. The author provides and describes the possible ways of legal protection in the above situations.
