The article gives the analysis of two dominant in the modern General theory of law point of view on the system of rights and freedoms of man and citizen. The author cites the opinions of representatives of formational and civilisational approaches to the assessment of the value and place of the Institute of human rights in modern legal systems of the world. Detailed discussion between lawyers engaged in country studies and lawyers dealing with the problem of universalism of the human rights. The author comes to the conclusion about the presence of inconsistencies in human rights assessment by the same researchers.
