The article describes the shortcomings of the procedural position of the persons controlling the debtor who are brought to subsidiary liability in the bankruptcy procedure. Shortcomings that do not allow these persons to defend themselves effectively, to appeal against judicial acts that affect their fate. The author analyzes the novelties in judicial practice and legislation of recent years, which were aimed at correcting the situation. He reveals the positive and negative sides of these novels. And he makes a forecast of the development of judicial practice in the future in connection with the adoption of the new provisions of the bankruptcy law.
