The law applicable to the joint IP ownership agreement

This article discusses the issues of conflict of laws regulation of the consensual regime of joint ownership of intellectual property rights. The author analyzes the problem of determining the law applicable to the form, formal validity and substance of the joint IP ownership agreement, the limits of party autonomy. The author concludes that the most effective way to provide legal certainty on the internal relations between IP co-owners is the conclusion of the joint IP ownership agreement with choice of law clause.
