Currently ensuring a friendly environment takes on special significance as one of the main activities of the modern rule-of-law state. The paper discusses the necessity of the increase of role of the Russian state as the guarantor of security and protection of environmental rights of the Russian citizens. The analysis of the provisions of the Constitution which include the state ecological functions is also provided. The problems are analysed in the context of present-day theory of state and law.
