Legal state as a base of constitutional and legal development of modern Russia

The research is dedicated to issues of constitutional and legal regulation and practical formation of legal state in Russia, which is the main point of modernization of state, power, law and society. The author gives critical interpretation to the common opinions about the declarative character of the principle of legal state, which can be determined as a certain unattainable ideal; it is necessary to seek after this ideal but it's hardly believable that it can be achieved. The result of the research shows that legal law as a base of constitutional system contains lots of other interconnected bases declared in the chapter one of Constitution of Russian Federation. This main constitutional principle is not only declared but partially realized in Russian constitutional practice. To achieve the ideal condition of legal statehood, legal awareness of society and state representatives must be totally rebuilt. It can be done through systematic evolutional integration of legal state bases into legal life. The final result of practical formation of legal state in Russia is achievement of an individual's safety and safety of his rights and freedoms, which is totally corresponding to the humanistic establishments of Russian Constitution.
