Legal Regulation of Relationships Arising from the Use of Technological Protection Measures for Intellectual Property Rights

Introduction: modern ways of using objects of copyright and related rights allow authors and copyright holders to use special technologies for self-protection of intellectual property rights. The civil legislation includes legal norms designed to regulate relations arising from the use of such means and technologies by copyright holders. At the same time, a theoretical study of the nascent institution is required. The paper examines the content of legal relations arising from the use of technical protection of copyright and related rights, and the legal nature of responsibility for countering such measures of self-protection of civil rights. Purpose: based on the analysis of the Russian legislation, to determine the content of legal relations arising from the use of technical protection of copyright and related rights, and the legal nature of responsibility for countering such measures of self-protection of civil rights. The research methodology includes the dialectical and sociological methods in jurisprudence, ensuring a comprehensive and thorough examination of the legal relations under study. Results: the authors have investigated the legal problems of self-protection of intellectual property rights using technical means and special technologies, as well as the legal nature of responsibility for overcoming limitations on the use of copyright or related rights established by the copyright holder using such technologies. Conclusions: the accessory nature of responsibility for overcoming limitations on the use of copyright or related rights established by the copyright holder using technical means and special technologies is proved. The proposals have been developed to improve the legal regulation of relations arising from the use of technical protection of copyright and related rights.
