The article examines the development of the institution of criminal liability for illegal entrepreneurship in Russia during the monarchical period. The relevant regulatory legal acts that determined liability for violations of established rules of economic activity, as well as scientific works that address the stated topic, are analyzed. The emphasis is placed on the study of the relevant norms in the Code of Criminal and Correctional Punishments of 1845 and the Criminal Code of 1903, where the legislator regulated these aspects at the systemic level, which, in turn, reflected the increasingly actively developing capitalist economic relations in Russia, and within their framework, entrepreneurship covered new types of economic activity that required additional legislative regulation, including protective regulation.
