The article is devoted to the legal regulation of euthanasia. The author considers two forms of euthanasia — active and passive. We investigate the experience of using this procedure in countries, which support euthanasia, such as the Netherlands, Belgium, Switzerland, France. The conditions for carrying out the euthanasia procedure in these countries are given. Separately, we analyze the situation in the Russian Federation in contrast to those in the countries that support euthanasia. There is a conflict between the norms of Federal Law «On the Fundamentals of Protecting the Health of Citizens in the Russian Federation», which, on the one hand, prohibits medical workers to satisfy the patient's request for putting an end to the use of the methods for prolonging his survival artificially, and, on the other, allows the refusal of patient or his relatives from medical intervention. So we have concluded that the absence of a significant difference between these concepts gives the legislative resolution for the passive form of euthanasia in Russia.
