Legal regulation section of debts jointly acquired by spouses

Purpose: Analysis of current legislation regulating section of debts, jointly acquired by spouses and its application in the context of the clarifications of the Supreme court of the Russian Federation. Methodology: the Main methods used in the work were: logical, comparative legal method and analysis. Results: the study identified a number of factors that hinder the application of p. 3 tbsp. 39 of the Family code of the Russian Federation regulating section jointly acquired spouses debt. Formulated a new version of this article, promoting elimination of the gap in the law and uniform application. Novelty/originality/value: the Novelty of this paper is the generalization of judicial practice on matters relating to the division of jointly acquired spouses debts with regard to clarification of the Supreme Court of the Russian Federation, data in 2014. on application of provisions of the Family code of the Russian Federation in conjunction with the provisions of the Civil and Civil procedure codes of the Russian Federation.
