The legal regime of joint ownership of exclusive rights to the invention: current issues in light of the application of the part iv of the Civil Code of the Russian Federation

The author considers the peculiarities of the legal regime of joint possession of exclusive rights to inventions protected in the territory of the Russian Federation. Analyzes the problems of application of certain norms of the Civil Code of the Russian Federation, controversial issues arising in connection with the use of the invention, determining the size of the share of the proceeds from the joint use of the invention, etc. and more persons need to consider the relationship of intellectual property rights and other branches of law (in particular, civil, hereditary, family). As the main regulatory tool recommends using the agreement between the co-owners of the right.
