The article discusses legal grounds for establishing a “special” regime of functioning of institutions and bodies of the penal system. These legal grounds are divided into external ones, associated with natural (man-made) phenomena, as well as with establishing other administrative-legal regimes (state of emergency or martial law) on institution territory which are provided for by the legislation; and internal grounds caused by illegal processes and phenomena developing among convicts (suspects, accused). The authors review administrative preventive measures implemented by officers of the Penal system of Russia in conditions of emergency and martial law, as well as in the regime of special conditions.
