Based on the analysis of the Russian state the legal and social foundations of the Russian state are reviewed. The social welfare state is a special type of a highly developed state, which provides a high level of social protection for all citizens through the activities of the state to regulate the social, economic and other spheres of society and establish social justice and solidarity. The social welfare state marks a high level of convergence and harmonization objectives of public relations and institutions of society. The welfare state must ensure the realisation of social and cultural rights protect them from violations. These peculiarities predetermined the difficulties and problems in the formation of Russia's rule-of-law and social welfare state. Comprehensive analysis of the statehood allowed to characterise the state as not only as a rule-of-law or social welfare state, but as both rule-of-law and social welfare one.
