Legal problems of transboundary insolvency and negative states of "bankrupt tourism"

The article analyzes the norms of private international law and the current Russian competition law relating to the specifics of cross-border insolvency (bankruptcy) procedures. The substantive and procedural aspects are considered, in particular, the problems of conflict binding for determining the jurisdiction, including on the basis of the design of the «center of main interests». After investigating law enforcement practice, the authors come to the conclusion that there is no uniform approach to the solution of this category of cases.
