The issues of the legal incentives as the means of the state innovation policy ensuring are considered in the article. Particular attention is given to the concept of innovation, the roles of innovation in modern society and state economy, the need for a legislative study of innovation processes. The author substantiates the conclusion on the importance of the legal incentive in the sphere of the innovation policy for the creation, development and use of the latest scientific achievements and their introduction into the economic and other spheres.
