Preventive function of the criminal liability for crimes committed in complicity

The article is devoted to a complex research of the institution of the criminal liability for crimes committed in complicity. The author of the article points out that the concept of positive liability reasonably places much emphasis on consciousness and voluntariness in following the regulations, and this is important for the general preventive effect of the criminal law. In the author’s opinion, the concept of the accessory nature of the complicity as a rule was mainly expressed by the absolute dependence of liability and the penalty for the participants on the liability and the penalty for the crime committer. With this it is mentioned that modern doctrine denies only that part of accessority which means the absolute dependence of liability and the penalty for the participants on the liability and the penalty for the crime committer. In this particular meaning the acknowledgement of the accessory nature of the compliance is unfamiliar for the modern theory and practice of the criminal law norms application. In the end of the research the author comes to the conclusion that the criminal legal liability of the accomplice in a crime – is the blame of the act injurious to the public and the person committed the crime expressed in the guilty verdict by the state in accordance with the criminal legal norms and associated with a penalty or other measures of executive legal impact. A special emphasis is laid on the author’s conclusion that the grounds for the criminal liability for every accomplice is a criminal act committed by every accomplice personally having the signs of the crime elements; although it is not directly stated by the criminal law that the organizer’s, the provoker’s and aider’s actions should be qualified in accordance with a particular part of article 33 of the Russian Federation Criminal Code, but the whole sense of such a reference is in defining the character of the person participation in the crime commitment.
