Termination of the management of an apartment house on the initiative of the management company

The author of the article analyzes the practice of commercial courts in disputes relating to the termination of the management of an apartment house on the initiative of the management company. The article considers the legal nature of the contract on management of an apartment building in the application of certain provisions of the Civil Code governing the termination of contracts, and the ability of the management company to cancel the contract through court on various grounds. The article cites the cases of litigation practice, when the apartment building management contract was terminated by the Management Company unilaterally in out of court manner.
