Wrongdoing in business: new legal acts and their application experience

Wrongdoing in business sector is a burning threat to economic resilience. Threats to resilience must imply adequate countermeasures. Alongside this, law-makers, taking into consideration public views on the use of criminal-justice response to squeeze on business, banned pre-trial detention for a measure of restriction in the so-called "wrongdoing in business sector". This paper has studied new acts regarding their constitutionality and analyzed court practice, drawing a conclusion that these changes in the Criminal Processing Code (CPC) fall short of the Constitution of Russian Federation and there are no neat relevancy criteria for wrongdoing in business sector.
