Criminal activity at providing surgery (transplantation of organs and (or) human tissues): legal and victymological aspect

It is proposed to make more active use of the possibilities of victimological crime prevention. Preventive work with potential victims should be aimed at reducing victimization, i.e. reducing the risk of becoming a victim of a crime. Implementation of victimological preventive work among other means should imply carrying out quickly-search actions in the specified environment of the population. With the proper organization of operational and investigative work, unlicensed healthcare institutions can and should be installed, in which organs are collected with subsequent transplantation to needy patients. It is proposed to fill the gap and to ensure the legal setting of the law “human organs and (or) tissues can not be sold”. Purchases and sales of bodies and (or) fabrics of the person attracts criminal liability according to the legislation of the Russian Federation”. Currently, criminal law does not provide for liability for non-compliance with this prohibition.
