Principle “action of the criminal law in space”

The article is devoted to the issues of the spatial effect of the criminal law in China. The problem of determining what kind of criminal law was in force against a foreign citizen or stateless person who committed a crime related to the movement in space (people, goods) from one country to another is disclosed. It is noted that with the development of network technologies, the principle of “action of the criminal law in space” is faced with new questions, for example, whether the virtual space is territorial, since the volume of the territory must include the virtual space to a certain extent, if any of the connection points of such a virtual space occurs on the territory subject. At the end, conclusions are drawn and the results are summarized.
