The principle of justice as a unification principle of incentives in criminal law

The article presents an analysis of various aspects of the principle of justice in criminal law carried out in order to determine the types of principles of criminal-legal incentives and establish their content. The methodological basis of the study included historical and systematic approaches, methods of formal logic (analysis, synthesis, comparison, generalization), and the legal-dogmatic method. The literature review allowed us to conclude that the existing doctrinal ideas in this area require clarification. In the course of the study, the criteria for the validity of certain fundamental ideas as principles of criminal-legal incentives were identified. The article proposes and substantiates an author’s version of expanding the system of principles of criminal-legal incentives. The practical significance of the work is that the results obtained can be used in the doctrinal interpretation of the law, as well as in the development of a concept for improving legislation.
