The principles of the choice of law in the cases containing foreign element are as follows: the parties’ autonomy principle, the closest connection principle, the territorial principle. These principles reflect the idea of the relationship localization. The difference is in the regulation method, namely whether the used criteria is rigid (formal) or ‘soft’. The formal method of regulation is represented by the traditional choice of law rules, based on the territorial principle. The soft method of regulation is represented by ‘soft’ choice of law rules, based on the principles of the parties’ autonomy and the closest connection. The given classification represents the tendency of the rigid regulation abandonment in favor of soft methods.
