Principles of legal regulation of the relations in the sphere of education

There has been considered the correspondence of such concepts as «a legal principle», «a principle of law» and «a principle of legal regulation». Comparative analysis of education laws has allowed showing the differences of approaches to corresponding terminology’s usage and widening the principles’ list. The conclusion drawn on the basis of the analysis has become a theoretical basis for further consideration of the question about the principles of legal regulation of the relations emerging in the sphere of education in the Russian Federation. It has caused the necessity to determine public relations’ duties, composing the subject of regulation of educational legislation. There has been made a conclusion that the concept «relations in the sphere of education» enshrined in the legislation demonstrates a wide approach to this term’s interpretation. The main attention has been paid to an educational policy as a constituent part of more general direction of a state policy - a social policy. The general conclusion of the work can be recognized as the necessity of educational legislation’s formation within the framework of existing principles with due regard for the variety of relations, appearing in the sphere of education.
