Decision for a Testimony On-Site Verification with the Involvement of a Minor

The testimony on–site verification is a specific investigative action characterised by dynamism and the need to perceive information of a different nature, and therefore requires careful preparation and considerable effort even before the start. Despite the fact that making a decision does not require a separate procedural act, this aspect of investigative activity has a very important criminalistic significance. The investigator's activity in question involves a detailed comparison of the information contained in the juvenile's testimony with other evidence collected in the criminal case. The purpose of this article is to determine the place of decision on the conducting of investigative action in the structure of testimony on–site verification with the participation of a minor, as well as to identify the circumstances that influence on the decision on its conducting. Results: it is determined that making a decision to verify the testimony on the spot is an independent stage of the investigative action. It has been established that the decision of testimony on–site verification is influenced by both subjective (the age of the minor, the level of development of his speech and memory) and objective (preservation of the place of the event as it existed at the time of capture by the minor event; features of the environment in which the event was perceived) circumstances.
