Compulsory occurrence of the property right to the ground sites as a phenomenon of the Russian right

Authors of article analyze legislative regulation of procedures of compulsory emergence of the right of a private, state and municipal property on the land lots. Law-enforcement practice with participation of bodies of the prosecutors office is considered, forcing municipal authorities to accept on balance property unnecessary them, including hydraulic engineering constructions. The conclusion that in civilized countries the phenomenon of compulsory emergence of the property right to real estate is absent becomes, and presence of that in our country doesnt promote growth of her authority on the world community.
