The problem of criminalization of vehicle insurance in Russia

The development of insurance market, the increasing demand for insurance services, and the growing number of customers contributed to the growth of fraud of various kinds, clearly demonstrating the problem of criminalization in vehicle insurance field. Russian insurers state that up to 15% of insured accidents can be called suspicious for FCAI (Fully Comprehensive Automobile Insurance) and MTPL (Mandatory Third Party Liability). It is difficult to reveal instances of deliberate fraud. Throughout the existence of Russian vehicle insurance market, so-called “experts” have appeared who earn money by organizing fraudulent accidents and claim for insurance payments as if they claim for their salary. On various distinctive examples of legal practice the author reviews some fraud schemes in vehicle insurance, focuses on the problem of fake insurance policies and defines the problem of criminalization of "traffic lawyers’” activity. The ways of solving the stated problems are proposed.
