The problem of the application of the statute of limitations under vindication of real estate

The article deals with the problems arising from the use of arbitration courts of the rules of limitation in the vindication of things. Particular attention is paid to the definition of the initial moment of the period of limitation in the reclamation of immovable property from illegal possession. Based on the analysis of the positions of higher judiciary author substantiates his own opinion on the solution of this problem - point of the period of limitation for the vindication of the claim shall be determined from the date when the claimant knew or actual disposal of things from his possession, or on the basis for the challenge registration of property rights for the defendant.
