Problem legal costs in defending results the cadastral value of the property

The author examines the problems caused by ambiguous jurisprudence allocate costs for the preparation of the report of the appraiser on the market value of real estate and conduct its examination to the category of the costs of the proceedings. Critically analyze the legal position on this issue as set out in the determination of the Judicial Board on Economic Disputes of the Supreme Court of the Russian Federation of February 12, 2015. It provides recommendations for solving the problem of collecting from the losing party costs incurred in connection with the payment service provider and an expert appraiser, while contesting the results of determination of the cadastral value.
