This article is devoted to the problems of compensation to the defendant for damages caused by the provision of a claim in civil proceedings. The author analyzes legislation and judicial practice, highlights problematic aspects of legislation related to the lack of legal regulation of counterclaim, suggests measures aimed at the legal regulation of this procedure.
