Problem issues in the construction and application of the regulation providing for criminal liability for disclosure of preliminary investigation data

The article examines the problems that affect the insufficient effectiveness of criminal law counteraction to the disclosure of preliminary investigation data. In particular, it is noted that the shortcomings in the construction of the norm provided for in Article 310 of the Criminal Code of the Russian Federation lead to problems in the application of this norm, as a result of which a number of infringements on the interests of justice, as well as on the legal rights and interests of citizens, including in the area of ensuring their safety and privacy, remain unpunished. Attention is drawn to the inconsistency of the norms of criminal and criminal procedural legislation. Ways to solve this problem are proposed.
